A report from the Leadership Conference on Civil Rights Education Fund shows that hate crimes targeting Hispanics rose 40% from 2003 to 2007. The report can be found here. Need quick help!
Per old instructions everyone was sending to Nebraska, and new instructions published are for 'direct filing'.
Do I follow direct filing rule or Nebraska only rule?
I am finally ready with medicals and photos and will be sending packet tomorrow.

I have seen references that if there are different I-140 apps approved per family, there is a possibility of going for the 485 stage separately. Also I have seen posts stating that one can go for AOS and the other for CP.
How do you communicate to USCIS that for one you are doing AOS and the other you are doing CP, with reference to the 485 stage? When does this really happen?

hi,
I have approved labor & I-140 with my employer and they filed for my H1B extension. If i would like to change the employer, what is the process i should go through with new employer regarding my GC? will they have to apply labor again for me or can they use this approved labor & I-140 and continue my GC from then so that i will not lose my priority date? If they cannot use my labor, is there any other way to use my priority date.Please advise on how to proceed...

Hi,
I did not find a conclusive answer to my situation when i looked up multiple immigration forums.Hoping you folks can help.
My H1B expired on Jan 13th 2011 and my employer filed for extension on Dec 17th (Regular process) for Client A using LCA filed for City A. The case status is in initial review. Due to project reasons employer now wants me to move to City B for the same client. But my company's immigration dept have some reservations doing the relocation while the H1 extension is not approved yet.
1) Can we move to a location other than the one filed in LCA before the extension approval.
2) Can we use a already existing LCA for city B.( My company already has a Blanket LCA in city B). what is the relationship between the validity of the LCA and the H1 extension that is being requested in the petition.
3) Can we file a new LCA for city B. would this need a H1 amendment
4) Will any of the above options negatively impact my extension approval.

USCIS has informally advised AILA that it will prioritize the adjudication of H-1B change of status cases for F-1 cap-gap students who are otherwise prohibited from continuing employment after September 30. Hello All,
I have my H1B immigration interview in New delhi on NOV 4th. I am not sure if this is a problem or not. In 2009 (Nov - Jan) I worked for a small company for designing websites. That employer doesnt have any of my details except my name . But, he said I am on his payroll and issued me few company cheques( I am on OPT at that time). At Feb I need to apply for my OPT extension, that small company dint give me their e verified number so I quit that job and joined a consultancy and applied for OPT extension. I got a new job in March. Now consultancy people filed for my H1 and it got approved. Now I am flying to India and need to get my H1 stamped. Would there be any problem about my last job where they dont have any of my details except my name?

Yes, you don't have to be in the US while the 485 is pending. You will need to be here for any appointments - fingerprinting, interview, etc. You also need to intend to be a permanent resident and work in the position listed on the I-140 (assuming this is an employment-based case). CIS might issue an RFE on the 485, asking for evidence of this, so you need to be able to provide it.

I definitely want to see other D2x vs. 1DsMkII tests before making any conclusions about the resolution, but even assuming the 1DsMkII holds the advantage, I'm certain that it won't be visible in real world prints that aren't at extreme sizes. That was a fairly good review, anyway. :)

One of my close friends got RFE on I-485. He is working for the Company A, but his labour and I-140 applied in June 07 from company B as substitution. Currently his I-140 got approved. But he got query as mentioned below. Can some one send sample letter .
You must submit a currently dated letter from your intended permanent employer, describing your present job duties and position in the organization, you proffered position (if different from your current date), the date you began employment and the offered salary or wage. This letter should be in the original and signed by an executive or officer of the organization who is authorized to make or confirm an offere of permanent
employment. The letter must also indicate whether the terms and conditions of your employment-based visa petition continue to exist.

Hi, I have a H1B from company A stamped in my passport and it has been expired in sep 2005. I joined company B in march 2004 and I have their I-797 valis till Jan 2008. I am going to India to stamp it on the passport. Is their any issue with this ? I heard that if one is changing the comany, he/she has to stamp the H1B of the new company on the passport within 6 months or so. Please help.
